1) Scope of Application
These Terms and Conditions of the company Alexa Klopfenstein, Boston Tea Campaign (hereinafter referred to as "Seller") shall apply to all contracts concluded between a purchaser (hereinafter referred to as "Client") and the Seller relating to all goods and/or services offered by the Seller.

2) Invitation to Treat
2.1 The Seller’s product descriptions do not constitute binding offers, but merely serve the purpose of an invitation to treat or deal.

2.2 The Client may submit the offer to the Seller. By clicking the button finalizing the order process, the Client agrees to be legally binding contract with regard to the goods and/or services contained in the shopping cart. The Client may make an offer to the Seller via postal service, e-mail or phone.

2.3 The Seller has the discretion to accept or refuse the Client's offer within five days by a order confirmation (e-mail); - by delivering ordered goods to the Client; or - by requesting the Client to pay after order receipt. Should the Seller not accept the Client's offer within the aforementioned period of time, it shall expire and no contract shall arise.

2.4 The offer period for acceptance runs from the day after the Client sent the offer and ends on expiry of the fifth day following the sending of the offer.

2.5 In case of an online order, the contract terms can by the Client via the password-protected customer account.

2.6 This contract is draft in English at the express request of the parties.

2.7 Order processing and contacting usually takes place via e-mail and automated order processing. It is the Client's responsibility to ensure that the e-mail address he/she provides for the order processing is accurate so that e-mails sent by the Seller can be received at this address. Particularly, it is the Client`s responsibility, if SPAM filters are used, to ensure that all e-mails sent by the Seller or by third parties commissioned by the Seller with the order processing can be delivered.

3) Right to Cancel
The Consumer has a right to cancel. Further details regarding the right to cancel can be found in the Seller's instructions for cancellations.

4) Prices and Payment Conditions
4.1 All prices are in US dollars. Unless otherwise provided in the Seller's product descriptions, all prices indicated by the Seller are final including the value added tax. There is no sales tax charged on tea purchases shipped to USA. Any possible additional delivery and dispatch costs are specified separately in the respective product description.

4.2 Payment can be made using one of the methods mentioned in the Seller's online shop.

4.3 In the case of deliveries outside Canada, additional costs may be incurred for which the Seller is not responsible and which are to be borne by the Client. This includes import duties (for example customs duties).

4.4 All orders (online, phone, email, letter) have to be paid in advance. Only after receiving the payment, the ordered goods will be shipped.

5) Shipment and Delivery Conditions
5.1 Should the delivery company return the goods to the Seller, because delivery to the Client was not possible, the Client shall bear the costs of any unsuccessful delivery. This shall not apply if the delivery cannot be made due to circumstances beyond the Client's control or if he has been temporarily impeded to receive the offered service, unless the Seller has given the Client prior reasonable notice.

5.2 The seller shall ship the ordered goods within 3 days after receiving the payment to the buyers’ destination. The seller does not guarantee the arrival time of the package. After handing over the package to shippers, it is their responsibility. The seller can, however, assist the buyer to track a package and help ensure that he or her will receive it.

6) Reservation of Proprietary Rights
The Seller retains title of ownership to the delivered goods until the purchase price has been paid in full.

7) Liability for Defects
The statutory liability for defects applies.

8) Applicable Law
The contract shall be governed and interpreted by and according to the laws of Ottawa, and the venue of any dispute shall be the City of Ottawa, Ontario irrespective of any applicable international agreements or principles of conflicts of laws.
Canada shall apply to all legal relationships between the parties under exclusion of the laws governing the international purchase

9.) Links
The sellers website provides links, so-called hyperlinks, to non-affiliated companies. Use of these links is at the users risk. By providing those links, the seller is in no way responsible for the content and security of those third-party web sites.


Right to return a product
You have the right to return a product within fourteen days after You received this product, without giving any reason.
You must inform us (Alexa Klopfenstein, 8823 Cedar Mountain Road, Divide, CO 80814, Phone (719)-900-8539; Email: alexa@bostonteacampaign.com ) of your decision to return a product by a clear statement (e.g. by mail or email) before the return period has expired. You may use our Return-Form (see below), but it is not obligatory.

If you decided to return a product we will reimburse to you all payments received from you, including the delivery costs, within fourteen days after we received the information about Your return-decision, latest after we received the returned product. We will make the reimbursement online, using e-mail. We will not charge You with any fees as a result of the reimbursement.
You should send back the product not later than fourteen days from the day on which you informed us about Your return decision.
Please be aware that You have to bear the costs of returning the product!

You are only liable for any diminished value of the product resulting from an undue use, handling ore storage of the product.

General information
Please prevent damage to and contamination of the product. Return the product, if possible, in the original packaging with all accessories and all packaging components.
